User Agreement

1.  General Provisions

• This User Agreement (hereinafter referred to as the Agreement) governs the use of the drcreative-video.com website by users, hereinafter referred to as the Platform, as well as the terms and conditions between the Seller (as the economic agent of the Platform) and the User.
• This Agreement is valid in the Republic of Uzbekistan and is governed by the Civil Code of the Republic of Uzbekistan, the Law "On the Protection of Consumer Rights," and other applicable laws.
• By using the Platform and purchasing video content created using artificial intelligence, the User accepts the terms and conditions in effect on the Platform.

2. Definitions

• "User" means an individual or legal entity who has visited the Platform and/or purchased content.
• "Video" means digital video material available on the Platform, created using artificial intelligence technologies.
• "Content" means video and related external information provided to the Buyer.
• "License" — a non-exclusive, non-transferable right to use the Video within the terms of the offer and this Agreement.
• "Account" — the User's personal account on the Platform.
• "Delivery" — the transfer of access to the Video via download, streaming, or sharing viewing/download links.
• "Personal Data" — any information identifying the User, or information permitted to be used by the application to identify the User for processing purposes within the law.

3. Acceptance of Terms

• Acceptance is the registration of an event on the Platform, placing an order and paying for services/content, or other actions indicating agreement with the terms on the website.
• If the User does not agree with the consequences, they must immediately cease using the Platform and the purchase.

4. Registration and Account

• To access external features (e.g., saving purchase history, quick purchase), the User can create an Account, fill in the required information, and provide valid contact information.
• The User undertakes to maintain the confidentiality of access to their Account data and not to transfer it to third parties. The Account owner is responsible for all actions performed through the Account.
• The Platform Administration reserves the right to suspend, review, verify, or delete an Account for violations of the Terms of Use or the law.

5. Platform Rules

• The User undertakes to use the Platform only for legal purposes and in accordance with applicable law.
• Prohibited: intellectual property infringement, distribution of Portuguese software, unauthorized access automation, virus hacking, spam, price manipulation, attempts to circumvent access restrictions, and other illegal activities.
• The User does not attempt to identify the consequences of source data, models, and codes, or their inclusion in video creation, unless expressly provided for in the offer and content license.

6. Payment and Content Access

• All payments are made using the payment methods available on the Platform. The price is indicated in the currency of the Republic of Uzbekistan (Uzbekistan soum) and may include VAT in accordance with current legislation.
• After payment, the User gains access to the Video in the format specified on the Platform (download, online viewing, access link).
• In the event of technical failures in the payment system, access to the content may be temporarily restricted until the issues are resolved and the payment is verified.

7.Intellectual Property and License

• All exclusive rights to the Video belong to the Seller or its licensees. The Buyer receives a license to use the Video in accordance with the terms and conditions described in the offer, agreements, and accompanying documentation.
• The license does not grant the right to resell, distribute as a standalone product, or publish publicly without attribution, which may violate the terms of the Copyright Holder.
• Any training data, AI models, and code used in the creation of the Video remain the property of third parties/developers and are not transferred to the Buyer, except for the final video material under the license terms.

8. Processing of Medical Data

• The Seller processes personal data to fulfill orders, maintain accounting records, communicate with users, and improve service in accordance with the laws of the Republic of Uzbekistan.
• Details regarding the processing of political data are governed by the Platform's Privacy Policy, which is posted on the website.

9. Privacy and Cookie Protection

• The User consents to the use of cookies and similar technologies for personalization and analysis purposes. Details are available in the Platform's Cookie Policy.
• Any data accessed through the Platform must be processed in accordance with applicable law.
  Security
• The User undertakes to ensure the security of their access data and notify the Administration of any unauthorized access to their Account or any possible vulnerability.
• The Administration will take reasonable measures to protect data, but will not be liable for damages if the breach occurs due to the fault of the User or third parties.

10. Limitation of Liability

• The Platform is provided on an "as is" and "as available" basis. The Administration does not guarantee the integrity, accuracy, completeness, or suitability of the Videos for the User's purposes.
• The Administration's liability is limited to the extent permitted by law. The Administration shall not be liable for consequential damages, lost profits, loss of data, etc., except in cases of intent or gross negligence.
• Software errors and discrepancies related to Video quality are governed by the terms of the offer and agreements.

11. User Content and Liability Therefor

• The User may post comments, reviews, or other content on the Platform within the limits of the Platform Rules. The User is responsible for complying with the law, copyright, and respecting the rights of third parties.
• The Administration reserves the right to remove any user content that violates the law, the Platform rules, or the terms of use.

12. Dispute Resolution

• All disputes arising from the use of the Platform and/or content shall be resolved in accordance with the laws of the Republic of Uzbekistan.
• If a settlement cannot be reached through negotiation, the dispute shall be heard in court at the location of the Seller or another location established by law.

13. Changes to Terms

• The Administration reserves the right to unilaterally amend the Agreement. Amendments will be published on the Platform and will take effect after a specified period (usually at least 7 days). Continued use of the Platform after such changes constitutes the User's acceptance of the new terms.

14. Other Terms

• Matters not regulated by the Agreement are governed by the laws of the Republic of Uzbekistan.
• Nothing in the Agreement creates an agency relationship between the User and the Platform Administration.

15. Notifications

• All notifications are sent via the contact information provided on the Platform: email, the "Contacts" section, or in your personal account.
